These forms must be returned to the office at least twenty (20) days prior to the starting date of the proposed lease. An application will not be stamped, processed and considered received until all required information has been submitted to the office.

Applicant Interview As a necessary part of this application process, the association will invite the prospective lessee(s) to meet with some of its members once the credit report, background check and other documents have been received. The association feels that this process is a particularly good opportunity to introduce you to some of your potential new neighbors, and outline to you the unique features of this condominium. In an effort to expedite the scheduling of this meeting, please indicate in the spaces below, any dates or times in the near future when a meeting would normally be inconvenient for you. Any such meeting would customarily be arranged on the first and third weeks of each month. If this sheet is not returned with the application, it will be assumed that any time is convenient for the interview.
Please be advised that no prospective lessee (except a seasonal tenant of three (3) months or less) is exempt from a personal (face to face) interview prior to tenancy.
No tenancy can take place before written approval is given.

APPLICATION FOR SEASONAL LEASE AND OCCUPANCY APPROVAL
1. This application for seasonal occupancy and lease approval must be completed in detail by each proposed lessee, other than husband/wife or parent/dependent child (which is considered one applicant. 2 If any question is not answered or left blank, this application may be returned, not processed and not approved. 3. Please attach a copy of the lease to this application. 4. Please attach a nonrefundable $100.00 processing fee to this application, made payable to NAPLES SANDPIPER BAY CLUB INC. for each applicant, other than husband/wife or parent/dependent child (which is considered one applicant). 5. Acceptance of the processing fee does not in any way constitute approval of this transaction. 6. The completed application must be submitted to the Association office at least 20 days prior to the desired date of occupancy (lease date). 7. Occupancy prior to Board approval is prohibited. 8. No lease shall be for less than 1 month nor for more than 6 months. Renewals or extensions of leases are subject to re-approval by the, Board of Directors. 9. NO PETS ALLOWED AT ANY TIME. 10. Use of this unit is for single-family residence only. No corporation, company, partnership, or trust may lease an apartment. 11. No commercial vehicles, trucks, boats, trailers, motor homes, mobile homes, campers, recreational vehicles, motorcycles, mopeds, etc. permitted to park on the premises. ************************************************************************************************************************ PERTAINING TO LEASING UNITS DECLARATION OF CONDOMINIUM Naples Sandpiper Bay Club, a Condominium 14. LEASING OF UNITS. All leases of units must be in writing. A unit owner may lease only his entire unit, and then only in accordance with this Section, after receiving the approval of the Association. The lessee must be one natural person. 14.1 Procedures. A. Notice. An owner intending to lease his unit shall give to the Board of Directors or its designee written notice of such intention at least twenty (20) days prior to the starting date of the proposed lease, together with the name and address of the proposed lessee, an executed copy of the proposed lease, and such other information as the Board may reasonably require. B. Approval. After the required notice and fees, and all information requested have been provided, the Board shall approve or disapprove the proposed lease within twenty (20) days. If the Board neither approves nor disapproves within the time stated above, such failure to act shall be deemed the equivalent of approval, and on demand the Board shall issue a written letter of approval to the lessee. C. Disapproval. A proposed lease shall be disapproved only if a majority of the whole Board so votes, and in such case the lease shall not be made. Appropriate grounds for disapproval shall include, but not be limited to, the following: 1. The notice is not accompanied by the required transfer fee and any security deposit required to be paid to the Association. 2. The unit owner is delinquent in the payment of assessments at the time the application is considered; 3. The unit owner has a history of leasing his unit to troublesome tenants and/or refusing to control and accept responsibility for the occupancy of his unit; 4. The real estate company handling the leasing transaction on behalf of the unit owner has a history of not adequately screen lessee applicants and recommending undesirable tenants; 5. The application on its face appears to indicate that the person seeking approval intends to conduct himself in a manner inconsistent with the covenants and restrictions applicable to the Condominium; 6. The prospective lessee has been convicted of a felony involving violence to persons or property, or a felony demonstrating dishonesty or moral turpitude. 7. The prospective lessee has a history of conduct which evidences disregard for the rights and property of others; 8. The prospective lessee evidences a strong probability of financial irresponsibility; 9. In the case of renewal, the lessee has during previous occupancy, evidenced an attitude of disregard for the provisions in the Condominium documents and House Rules; or 10. The prospective lessee gives false or incomplete information to the Association as part of the application procedure. D. Failure to Give Notice. If proper notice and information is not given, the Board at its election may approve or disapprove the lease without prior notice. If it disapproves, the Board shall proceed as if it received notice on the date of such disapproval; however, the proposed lessee may provide the Board with the required notice and request reconsideration. Any lease entered into without approval or in violation of the above provisions shall, at the option of the Board, be treated as a nullity, and the Board shall have the power to evict the lessee with five (5) days notice, without security consent to such eviction from the unit owner. E. Applications, assessments, notice. Applications for authority to lease shall be made to the Board of Directors on such forms and include such terms and security deposits as the Board may, from time to time, provide. The legal responsibility for paying condominium assessments may not be delegated to the lessee. F. Notice of disapproval shall be sent or delivered to the unit owner. To facilitate approval of leases proposed during times when many of the members are not in residence, the Board of Directors may by resolution delegate its approval powers to an ad hoc committee, which shall consist of at least three (3) members. 14.2 Term of Lease and Frequency of Leasing. No unit may be leased for a term of less than thirty (30) days. No lease may be for a period of more than one (1) year, and no option for the lessee to extend or renew the lease beyond a one year period without association approval shall be permitted. However, the Board may, in its discretion, approve the same lease from year to year. No subleasing or assignment of lease rights by the lessee is allowed. 14.3 Occupancy During Lease Term. No one but the lessee, his family within the first degree of relationship by blood, adoption or marriage, and their guests may occupy the unit. The total number of overnight occupants of a leased unit is limited to two (2) persons per bedroom. 14.4 Occupancy in Absence of Lessee. If a lessee absents himself from the unit for any period of time during the lease term, his family within the first degree of relationship already in residence may continue to occupy the unit and may have house guests subject to all the restrictions in 17.3 above. If the lessee and all of the family members mentioned in the foregoing sentence are absent, no other person may occupy the unit. 14.5 Use of Common Elements and Association Property. To prevent overtaxing the facilities, a unit owner whose unit is leased may not use the recreation or parking facilities during the lease term, but may use his boat dock if he has one, and the tenant is not using it. 14.6 Regulation by Association. All of the provisions of the condominium documents and the rules and regulations of the Association shall be applicable and enforceable against any person occupying a unit as a lessee or guest of the same extent as against an owner. A covenant on the part of each lessee to abide by the rules and regulations of the Association and the provisions of the Condominium documents, designating the Association as the owners agent, with the authority to terminate any lease agreement and evict the tenants, in the event of violations by the tenants of such covenant, shall be deemed to be included in every lease agreement, whether oral or written, and whether specifically expressed in such agreement or not. 12.5 Minors. There are no age restrictions for occupants of units. All occupants under eighteen (18) years of age shall be closely supervised at all times by an adult to insure that they do not become a source of annoyance to other residents.
